Promotion of Access to Information Act 2 of 2000 ("PAIA"), read with the Protection of Personal Information Act 4 of 2013 ("POPIA")

1. Introduction and purpose

This Manual is published in terms of section 51 of PAIA. It is intended to help any person who wishes to request access to records held by MyWealth Capital (Pty) Ltd ("MyWealth Capital", "the Company"). It sets out the categories of records the Company holds, how to request access to them, the applicable fees, and the remedies available if a request is refused. It also explains how requests relating to your Personal Information are dealt with under POPIA.

3. The Information Regulator's Guide on how to use PAIA

The Information Regulator has compiled a Guide, in terms of section 10 of PAIA, on how to use the Act. 4. Categories of records held by the Company

4.1 Records held in terms of other legislation

The Company holds records in accordance with, among others, the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Financial Intelligence Centre Act 38 of 2001, POPIA, and the Electronic Communications and Transactions Act 25 of 2002. Access to these records is governed by the relevant legislation and, where applicable, this Manual.

4.2 Records that may be requested under PAIA

Subject to the grounds for refusal in PAIA, the following categories of records may be requested:

Company records: incorporation documents, memorandum of incorporation, statutory registers, and minutes.

Financial records: accounting records, financial statements, tax records, and invoices.

Employee records: contracts, payroll, and personnel records (subject to the privacy rights of third parties).

Customer and user records: registration details, profile and eligibility information, and records of products you engaged with.

Operational records: agreements with Partner Providers and operators, marketing records, and correspondence.

IT and security records: system, access, and information-security records.

4.3 Records automatically available

Certain records are available without a formal PAIA request, including this Manual, our Privacy Policy, and our Terms & Conditions, all of which are published at https://www.mywealthcapital.co.za.

5. How to request access to a record

A requester must complete the prescribed Request for Access to Record form (Form 02 of the PAIA Regulations) and submit it to the Information Officer at the address or email above. The request must:

provide sufficient detail to enable the Company to identify the record and the requester;

identify the right the requester is seeking to exercise or protect, and explain why the record is required for that purpose (for requests other than for your own Personal Information);

specify the form of access required and the manner in which the requester wishes to be notified of the decision; and

where the request is made on behalf of another person, include proof of the capacity in which the requester is making the request.

The Company will respond within 30 days of receiving a valid request, unless that period is lawfully extended. The requester will be notified of the decision and, where access is granted, of any fee payable and the form of access.

6. Fees

Two types of fee may apply under PAIA: a request fee and an access fee. A request for access to a record (other than a request for your own Personal Information) may attract a prescribed request fee, which must be paid before the request is processed. An access fee may also be charged to cover the cost of reproduction, search, and preparation, calculated in accordance with the PAIA Regulations. The Information Officer will notify the requester of any fee payable before processing the request, and may require a deposit where preparation is likely to take more than the prescribed time. Requests for access to your own Personal Information are not subject to a request fee.

7. Grounds for refusal

The Company may refuse access to a record on any of the grounds set out in Chapter 4 of Part 2 of PAIA, including:

the mandatory protection of the privacy of a third party who is a natural person;

the mandatory protection of commercial information of a third party (for example trade secrets, or financial, commercial, scientific or technical information);

the protection of confidential information supplied by a third party;

the protection of the safety of individuals and of property;

records privileged from production in legal proceedings;

the protection of the Company's commercial information, including trade secrets and research; and

where access would be likely to prejudice or otherwise frustrate a lawful process.

If only part of a record may lawfully be withheld, access will be granted to the remainder.

8. Remedies if a request is refused

There is no internal appeal against a decision of the Information Officer of a private body. A requester who is dissatisfied with a decision may either lodge a complaint with the Information Regulator, or apply to a court with jurisdiction for appropriate relief, in accordance with PAIA. Complaints to the Information Regulator may be sent to PAIAComplaints@inforegulator.org.za.

9. Requests relating to your Personal Information (POPIA)

If you wish to request access to, or the correction or deletion of, Personal Information the Company holds about you, you may contact the Information Officer at info@mywealthcapital.co.za. Requests for access are dealt with using the prescribed PAIA Form 02; requests to correct or delete Personal Information are dealt with using the prescribed POPIA form (Form 2 of the POPIA Regulations). The Company will deal with such requests in accordance with POPIA and this Manual.

This Manual is available, free of charge, on the Company's website at https://www.mywealthcapital.co.za, and on request from the Information Officer. It is also available for inspection at the offices of the Company during normal business hours.
